A photo publisher is any entity that puts photographs before the public, with no intermediary between the “photo publisher” and the viewer.

Thus:

• A social media platform is a “photo publisher” (because there is no intermediary between the publisher and the viewer)

• A photographer who publishes photos on their own monosite is a “photo publisher” (because there is no intermediary between the publisher and the viewer)

• But a photographer who publishes photos on social media is NOT a “photo publisher” (because the social media platform is an intermediary between the photographer and the viewer)
